These terms govern your use of the DataZen Global website and the services we provide. Please read them carefully before engaging our services.
Acceptance of Terms
By accessing the DataZen Global website at datazenglobal.com or by engaging DataZen Global Ltd for any services, you agree to be bound by these Terms of Service ("Terms").
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, please do not use our website or engage our services.
Our Services
DataZen Global Ltd provides B2B lead generation and data services including, but not limited to:
- Appointment setting and meeting booking
- LinkedIn lead generation and outreach management
- Account-based marketing (ABM) programmes
- Data as a Service β ICP-matched contact list building
- Data enrichment β appending and verifying contact records
- Email deliverability consulting and remediation
- End-to-end outbound lead generation management
The specific scope, deliverables, timeline, and fees for any engagement are set out in a separate Statement of Work or Service Agreement between DataZen Global Ltd and the client. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement shall take precedence.
Engagement & Payment
Fees
All fees are as agreed in the applicable Service Agreement or Statement of Work. Fees are quoted in the currency specified in the agreement and are exclusive of applicable taxes unless otherwise stated.
Payment terms
Unless otherwise agreed in writing, invoices are due within 14 days of the invoice date. DataZen Global reserves the right to suspend services for accounts with overdue invoices.
Refunds
Given the nature of our services (research, outreach execution, and data delivery), fees paid for work already commenced or delivered are generally non-refundable. Specific refund provisions may be set out in individual Service Agreements.
Client Obligations
In order for DataZen Global to deliver services effectively, clients agree to:
- Provide accurate and complete information about their business, ICP, and target markets
- Make themselves available for onboarding calls, reviews, and feedback within agreed timeframes
- Ensure that their intended use of our services complies with all applicable laws, including CAN-SPAM, GDPR, CASL, and any other relevant anti-spam or data protection regulations in their jurisdiction
- Not use our services or deliverables for any unlawful, deceptive, or harmful purpose
- Not engage in outreach that constitutes harassment, unsolicited bulk messaging in violation of law, or any activity that could damage the reputation of DataZen Global or our sending infrastructure
Intellectual Property
Client deliverables
Upon full payment of fees, DataZen Global assigns to the client all rights in deliverables specifically created for them under the engagement β including contact lists, email sequences, campaign reports, and written strategies.
DataZen Global proprietary materials
Our methodologies, frameworks (including The Intelligence Stackβ’), internal processes, templates, and general-purpose tools remain the intellectual property of DataZen Global Ltd. Clients receive a licence to use these in the context of their engagement, but not to resell, sublicence, or distribute them.
Website content
All content on datazenglobal.com β including text, design, graphics, and copy β is the property of DataZen Global Ltd and may not be reproduced without written permission.
Data & Compliance
DataZen Global provides B2B contact data for legitimate business outreach purposes. Clients are responsible for ensuring their use of that data complies with applicable law in their jurisdiction.
All B2B contact data compiled by DataZen Global is sourced from publicly available professional information and is intended solely for legitimate B2B outreach. We process this data under the legitimate interests basis applicable to B2B marketing.
Clients agree not to:
- Use our data for consumer marketing, illegal purposes, or any purpose not agreed in the engagement scope
- Share our data deliverables with third parties outside the client organisation without our written consent
- Use our data in any way that violates GDPR, CAN-SPAM, CASL, or other applicable regulations
DataZen Global maintains a suppression process. Individuals who wish to be excluded from our B2B data may request removal by emailing hello@datazenglobal.com.
Confidentiality
Both parties agree to treat as confidential any non-public information received from the other party in connection with an engagement ("Confidential Information") and not to disclose it to third parties without prior written consent.
This obligation does not apply to information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party; or (c) is required to be disclosed by law or regulatory authority.
Confidentiality obligations survive termination of the engagement for a period of three (3) years.
Limitation of Liability
DataZen Global provides outbound pipeline services designed to generate meetings and pipeline opportunities. We do not guarantee specific revenue outcomes, conversion rates, or closed deals, as these depend on factors outside our control including client sales performance, market conditions, and product-market fit.
To the maximum extent permitted by law:
- DataZen Global's total liability to a client under any engagement shall not exceed the total fees paid by that client in the three (3) months immediately preceding the event giving rise to the claim
- DataZen Global shall not be liable for any indirect, consequential, special, or punitive damages, or for loss of revenue, profit, data, or business opportunity
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
Termination
Either party may terminate an engagement with 30 days' written notice, unless a different notice period is specified in the applicable Service Agreement.
DataZen Global may terminate an engagement immediately if:
- The client materially breaches these Terms or the applicable Service Agreement and fails to remedy the breach within 14 days of written notice
- The client becomes insolvent or enters insolvency proceedings
- The client uses our services for unlawful or harmful purposes
Upon termination, fees for work completed up to the termination date remain payable. DataZen Global will deliver any completed deliverables owed at termination.
Website Use
You may use the DataZen Global website for lawful purposes only. You agree not to:
- Attempt to gain unauthorised access to any part of the website or its underlying systems
- Use the website to transmit spam, malware, or any harmful content
- Scrape, copy, or republish website content without written permission
- Use the website in any way that could damage, overburden, or impair its functionality
We reserve the right to restrict or terminate access to the website for any user who violates these terms.
Governing Law & Disputes
These Terms and any engagement between DataZen Global Ltd and a client are governed by the laws of England and Wales.
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved within 30 days of written notice, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.
These Terms do not affect any statutory rights you may have as a consumer under applicable law. However, as DataZen Global provides exclusively B2B services, all clients are expected to be engaging in a business capacity.
